Our service providers include e.g. data centres, analysing services and marketers. Our service providers may not process your data for other purposes or for themselves. It is of special concern to us to have the following hints enabling you to know at all times which categories of personal data are collected during your visit to our website and how we process them afterwards.

2. Purpose and Legal Bases of Data Processing

We store your data for the performance of our contractual services such as delivery, billing and payment. The legal basis for data processing is the contract with you (Art. 6 Subsec. 1 lit. b GDPR). Your data are processed by us to the legally required extent, including our archiving and storage obligations under the German Commercial Code (Art. 6 Subsec. 1 c GDPR). In addition, we use your data for direct mail, but also to send you information on our products, services and campaigns (as per Art. 6 Subsec. 1f GDPR) to win you as a potential customer (Information as per Art. 13 Subsec. 1 d GDPR). You may at any time object to the use of your data for direct marketing purposes by contacting the above address. Further recipients of these data during order handling and contract performance are forwarders (only address data), payment service providers (only payment data) and for direct mail also mail service providers (only address data). The processing duration is a function of the contract purpose and of other associated statutory requirements for the conservation and supply of proof. The data are used for direct mail only if you have raised no objection to it.

3. Your Data Protection Rights & Right of Revocation

You are entitled to the following rights during the processing of personal data about which you will be informed in detail in the following sections.

  • Right to information on part of the Controller over the personal data in question
  • Right to correction or erasure or to processing restrictions
  • Right to objection when the processing of your personal data rests on a balancing of interests (Art. 6 Subsec. 1f GDPR) or when the processing is required for the performance of a task in the public interest or in the exercise of a public authority assigned to the Controller (Art. 6 Subsec. 1e GDPR).
  • Right to data portability
  • Right to revoke your consent when processing of your personal data rests on your consent (Art. 6 Subsec. 1a or Art. 9 Subsec. 2a GDPR).

Right to complain to a supervisory authority

You have the right at any time to object to the processing of your personal data for reasons resulting from your personal situation provided the statutory conditions against the processing of your data are met. If you object to the processing of your data for advertising purposes or wish to revoke a consent previously granted, a brief notice to our Data Protection Officer by e-mail to dataprotection@NGCtransmission.com or by regular mail to NGC Transmission Europe GmbH, Schifferstraße 196, 47059 Duisburg at any time is sufficient. Your data will then no longer be processed for the purposes covered by the objection to advertising or by the revocation. The legality of processing up to the time of an objection or revocation remains unaffected. After an objection against processing your personal data for advertising purposes or the revocation of your consent, we are required under the provisions of the German supervisory authority for data protection to enter the necessary data (name, address, e-mail address) into our internal advertising blacklist and to store (i.e. block) them permanently - for this purpose only - to allow comparing them against future advertising lists (Art. 21 Subsec. 3, Art. 17 Subsec. 3b, Art. 6 Subsec. 1c GDPR). In this way, the observation of your objection to advertising or the revocation of your consent can be permanently secured. If you have any questions on the processing of your personal data by us, we will of course be pleased to inform you at any time about the data concerning you. In addition, if the statutory requirements are met, you also have rights to the correction, erasure, processing restriction, objection and the right to data portability. In all these cases, please contact our Data Protection Officer (at the contact data in No. 1.). Finally, you have the right to lodge a complaint with the competent data protection supervisory authority.

4. Processing of Personal Data on our Website

  • Accessing our Website

NGC Transmission Europe GmbH – as is customary and necessary for the use of websites - processes so-called server log files whenever a user accesses our website. When doing so, our web server logs the domain name or IP address of your computer, the filename and the URL which was requested, plus the http answer code and possibly the URL that leads a user to our website (legal basis Art. 6 Subsec. 1b GDPR).

For technical reasons, this way of proceeding is customary and necessary to allow the use of a website. We are supported in the process by our technical service providers whom we employ as data processors. The above data are recorded and used to defend against unlawful use or cyberattacks on our webserver (Art. 6 Subsec. 1f GDPR). The data are deleted after 6 months.

  • Google Analytics

Our website uses the functions of the web analysis service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". These are text files which are stored on your computer and permit an analysis of your website use. As a rule, the information generated by the cookie on your website use are transferred to a Google server in the USA and stored there. The storage of Google Analytics cookies (legal basis Art. 6 Subsec. 1f GDPR) takes place due to our legitimate interest in the analysis of user conduct to optimise both our online offers and our advertising.

For this, we have the support of Google as a data processor. Google uses the information to analyse the website use by the visitor, compile reports on website activities and to provide other services connected with website and Internet use for the website operator. The IP address transmitted by your browser to Google Analytics is not aggregated with other Google data.

IP Anonymization: Our website has activated the IP anonymization function. This causes your IP address to be truncated by Google within the EU or in a member state of the Treaty on the European Economic Area. Only in exceptions is the full IP address transmitted to a Google server in the USA and truncated there. The legal basis for the transmission of personal data is the so-called EU-US Privacy Shield.

  • Browser Plug-Ins

You can prevent the storage of cookies by a corresponding setting of your browser. We point out, however, that in this case it is possible that not all functions of this website are available to the full extent. In addition, you can prevent the collection of cookie-generated data on your website use (including your IP address) as well as the processing of these data by Google by downloading and installing the browser plug-in available from the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

Revocation against Data Processing:

You can prevent the processing of your personal data by Google Analytics by accessing the following URL: https://tools.google.com/dlpage/gaopout?hl=de. It creates an Opt-Out-Cookie, which will prevent the accessing of your data during future visits to our website: Deactivate Google Analytics. Data Processing: We have concluded a data processing agreement with Google and fully implement the strict requirements of German data protection authorities on the use of Google Analytics.

Demographic features of Google Analytics: This website uses the function "demographic features" of Google Analytics. This allows the preparation of reports which contain statements on age, gender and interests of website visitors. These data come from interest-induced advertisements of Google and from the visitor data of third-party providers. These data cannot be allocated to a particular person. You can disable this function at any time via the ad settings in your Google account or generally prohibit the logging of your data by Google Analytics as shown in the menu point "Objection to Data Logging".

  • Contact & Enquiries

If you have any questions or requests, we will be pleased to be at your disposal. We process your data in response to your product or service enquiry (Art. 6 Subsec. 1b, f GDPR). The supply of address and telecom data marked as obligatory is then required to attend and reply to your request.

The voluntary supply of further data facilitates the processing of your enquiry. In principle, with business or commercial correspondence, data from your enquiry are stored after answering an enquiry for a period of six years (Sec. 257 Subsec. 4 HGB, Art. 6 Subsec. 1c GDPR).

  • Change of Purpose

If our processing purpose changes over time, we will inform you in advance with an updated note on data protection.

  • Extended Storage Periods

The stated storage periods may be correspondingly extended in a given case, in particular when data are processed for different purposes or when a longer statutory or contractual archiving period applies.

5. What are Obligatory Data or Mandatory Entries?

When certain data fields for data collection are designated as mandatory or marked with an asterisk (*), the supply of these data is either legally or contractually prescribed, or we require them for contract conclusion, a requested service or for the stated purpose.

Even with mandatory entries, the disclosure of such data is of course at your discretion. However, their non-supply may result in an inability to perform the contract, provide the requested services or achieve the stated purpose.

6. Information on the Subject of Cookies

Using web analysis technology, the website of our Company collects data for marketing and optimisation purposes. These are described and explained separately and in greater detail below. In the interest of better comprehension, we wish to explain the subject of cookies.

Cookies are small text files that are stored on your computer. They are used to allow the recognition of your web browser. From these data user profiles are generated using a pseudonym. 7. Data Security

We take technical and organizational security measures to protect your personal data from accidental or intentional manipulations, loss, destruction or unauthorized access and to ensure your rights while observing applicable EU and German data protection regulations. The measures taken are designed to ensure the confidentiality and integrity of your data as well as the long-term availability and load capacity of the systems and services involved in processing your data. They are also designed to rapidly restore data access and availability in the event of a physical or technical malfunction.

Our security measures also include the encryption of your data. Any information which you enter online is technically encrypted and only transmitted thereafter. This means that these data cannot be viewed by an unauthorized party at any time. Our data processing and security measures are being constantly improved to keep up with latest technical developments.

The employees of NGC Transmission Europe GmbH are or will be committed in writing to confidentiality and to the observation of the data protection requirements of the GDPR.

8. Job Applications

Our Company collects and processes personal data of job applicants for application purposes. Processing is also possible by digital means. In particular this is the case when an applicant submits his or her application records to the data controller in charge digitally, e.g. by e-mail or via an application form on the webpage.

If the data controller in charge concludes an employment contract with an applicant, the data transmitted for creating the employment contract will be stored observing the statutory provisions in their regard. If no employment contract is concluded between the applicant and the data controller in charge, the application records will be automatically deleted three months after the announcement of the hiring decision, provided the deletion does not run counter to other legitimate interests of the data controller. Other legitimate interests in this sense are e.g. the requirement of proof for proceedings under the Equal Treatment Act (AGG).
